Introduction
The domain (website) name www.cineartery.com (hereinafter referred to as "Website") is owned by BharatVarsh Pictures LLP ("cineartery" or "Bharatvarsh Pictures LLP" or "us" or "we" or "our"), a company incorporated under the Limited Liability Partnership Act, 2008 regulates the LLPs, having its registered office located at No.381, 2nd Main, 4th Cross, Padhuka Madira Rd, BHCS Layout, Subramanya pura, Bangalore - 560 034, Karnataka, India (hereinafter referred to as "cineartery").
1.1 Contract
Please read the Conditions of Use document carefully before you start using the www.Cineartery.com website & Apps. By creating an account or accessing or by clicking to accept or using our Services (described below), you are agreeing to enter into legally binding contract with Cineartery, on behalf of yourself or on behalf of your employer or Company or any other entity (even if you are using third party credentials or using our Services on behalf of a company). If you do not agree to this contract (“Contract” or “User Agreement”), do not create an account or access or otherwise use any of our Services. If you wish to terminate this Contract at any time, you can do so by closing your account and no longer accessing or using our Services.
the entity you represent (whenever the context) “you” or “user” Shall means you as a user of the Site, any natural or legal person who has agreed to become a buyer on the Website by providing Registration Data while registering on the Website as Registered User using the computer systems.
When You use any of the services provided by Us through the Website, including but not limited to, (e.g. Reviews ), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.
1.2 Account Members or Membership & Visitors Eligibility,
When you register and join the Cineartery you become a “Member”. If you have chosen not to register for our Services, you may access certain features as a “Visitor.”
1.3 Changes.
We may modify this Contract, our Privacy Policy and our Cookie Policy from time to time. If required by applicable law or we make material changes to this Contract, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any of these changes, you may close your account. Your continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms as of their effective date.
2. Obligations
2 .1 Service Eligibility
The Services are not for use by anyone under the age of 18. If you are a minor i.e. under the age of 18 years, you shall not register as a User of the CineArtery website or Apps and shall not transact on or use the website or Apps. As a minor if you wish to use or transact on website, such use or transaction may be made by your legal guardian or parents on the Website. cineartery reserves the right to terminate your membership and / or refuse to provide you with access to the Website if it is brought to cineartery notice or if it is discovered that you are under the age of 18 years.
2.2 Your Account and Registration
If you use the website, You shall be responsible for maintaining the confidentiality of your Display Name and Password and for restricting access to your computer to prevent unauthorised access to your account. Members are account holders. You agree to: (1) protect against wrongful access to your account (e.g., use a strong password and keep it confidential); (2) not share or transfer your account or any part of it (e.g., sell or transfer the personal data of others by transferring your connections); and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Website and refuse to provide You with access to the Website. As between you and others (including your employer), your account belongs to you. However, if the Services were purchased by another party for you to use (e.g., Budgeting or Schedule or Seller subscription bought by your employer), the party paying for such Service has the right to control access to and get reports on your use of such paid Service; however, they do not have rights to your personal account.
2.3 Payment & Platform for Transaction
If you buy any of our paid Services, you agree to pay us the applicable fees and taxes and you agree to the additional terms specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that:
a) Your purchase may be subject to Payment gateway or differences in prices based on Duration, Service & product.
B) We may store and continue billing your payment method (e.g., credit card), even after it has expired, to avoid interruptions in your paid Services and to use it to pay for other Services you may buy. You may update or change your payment method.
C) If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, cancel before the renewal date.
D)We may modify our prices effective prospectively upon reasonable notice to the extent allowed under the law.
E) All your paid Services are subject to CineArtery’s refund policy.
F) We may calculate taxes payable by you based on the billing information that you provide us. You can get a copy of your invoice through your CIneArtery account settings under “Purchase History”.
G) We use or access to your GST Number for B2B service,
H) For using some of Services, we may charge addition platform charges.
I) The Website or Apps is only a platform that can be utilized by Users to reach a larger base to Producers and Worker/Builder or services. cineartery is only providing a platform for communication and it is agreed that the contract for sale of any of the products or services shall be a strictly bipartite contract between the Producers and the employee. At no time shall cineaertery hold any right, title or interest over the products or serivce nor shall cineartery have any obligations or liabilities in respect of such contract. cineartery is not responsible for unsatisfactory or delayed performance of services or damages.
H) Free Trials - Where applicable, your free trial period will commence by clicking ‘Start Free Trial’, selecting a plan, and completing the registration process. The free trial period of your subscription lasts for 30 days, or as otherwise specified. Free trials are for new and certain former users only. CineArtery reserves the right, in its absolute discretion, to determine your free trial eligibility. We will begin billing your payment method for subscription fees at the end of the free trial period of your subscription unless you cancel prior to the end of the free trial period. To view the specific details of your trial or your subscription, visit our website and click the “Subscription“ link under settings available at the top of the pages of the CineArtery website. You will not receive a notice from us that your free trial period has ended or that the paying portion of your subscription has begun. We will continue to bill your payment method for your subscription fee until you cancel.
2.4 Communications
When You use the Website or send emails or other data, information or communication to us, you agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.
2.5 Notices and Messages
You agree that we will provide notices and Notification and messages to you in the following ways: (1) within the Services or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.
2.6 Sharing
Our Services allow sharing of information (including content) in many ways, such as through your profile, posts, articles, group posts, links to news articles, job postings, messages, and InMail's. Depending on the feature and choices you make, information that you share may be seen by other Members, Visitors, or others (on or off the Services). For job searching activities, we default to not notifying your connections or the public. So, if you apply for a job through our Services or opt to signal that you are interested in a job, our default is to share it only with the job poster.
To the extent that laws allow this, we are not obligated to publish any content or other information on our Services and can remove it with or without notice.
3 Right & Limits
3.1 Personal Information, Data and Privacy
You and CineArtery agree that we may access, store, process, and use any information (including content and/or personal data) that you provide in accordance with the terms of the Privacy Policy and your choices (including settings).
You agree to only provide content and other information that does not violate the law or anyone’s rights (including intellectual property rights). You have choices about how much information to provide on your profile but also agree that the profile information you provide will be truthful.
You are responsible for maintaining confidentiality of your username, password and other sensitive information. You are responsible for all activities that occur in your user account, and you agree to inform us immediately of any unauthorized use of your user account by email to cineartery@gmail.com or by calling us on any of the numbers listed on contact us Page.
Feeback: By submitting suggestions or other feedback regarding our Services to LinkedIn, you agree that LinkedIn can use and share (but does not have to) such feedback for any purpose without compensation to you.
3.2 Others’ Content, Products and Services, Events with sites and Apps
Others’ Content: By using the Services, you may encounter content or other information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive, or otherwise harmful. You agree that we are not responsible for content or other information made available through or within the Services by others, including Members.
Others’ Products and Services: CineArtery may help connect you to other Members (e.g., Members like producer searching of movie editor or our enterprise recruiting, jobs, sales, or marketing products) who offer you opportunities (on behalf of themselves, their organizations, or others) such as offers to become a candidate for employment or other work or offers to purchase products or services. You acknowledge that CIneArtery does not perform these offered services, employ those who perform these services, or provide these offered products.
You further acknowledge that CineArtery does not supervise, direct, control, or monitor Members in the making of these offers, or in their providing you with work, delivering products or performing services, and you agree that (1) CineArtery is not responsible for these offers, or performance or procurement of them, (2) CineArtery does not endorse any particular Member’s offers, and (3) CineArtery is not an agent or employment agency on behalf of any Member offering employment or other work, products or services. With respect to employment or other work, CineArtery does not make employment or hiring decisions on behalf of Members offering opportunities and does not have such authority from Members or organizations using our products.
Other’s Events: Similarly, CineArtery may help you register for and/or attend events organized by Members and connect with other Members who are attendees at such events. You agree that (1) CineArtery is not responsible for the conduct of any of the Members or other attendees at such events, (2) CineArtery does not endorse any particular event listed on our Services, (3) CineArtery does not review and/or vet any of these events or speakers, and (4) you will adhere to the terms and conditions that apply to such events.
3.3 Limits
CineArtery reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other Members. CineArtery reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services. We can also remove any content or other information you shared if we believe it violates.
3.4 intellectual Property Rights, TradeMark & Copy Right
CineArtery reserves all of its intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. CineArtery, and logos and other CineArtery trademarks, service marks, graphics and logos used for our Services are trademarks or registered trademarks of Bharatvarsh Pictures LLP.
3.5 Recommendations
We use the data and other information that you provide and that we have about Members and content on the Services to make recommendations for connections, content, ads, and features that may be useful to you. We use that data and other information to recommend and to present information to you in an order that may be more relevant for you. For example, that data and information may be used to recommend jobs to you and you to recruiters and to organize content in your feed in order to optimize your experience and use of the Services. Keeping your profile accurate and up to date helps us to make these recommendations more accurate and relevant.
4 Disclaimer and Limit of Liability
4.1 No warranty
CineArtery Website/Apps, all the materials and products and services, AND ITS AFFILIATES MAKE NO REPRESENTATION OR WARRANTY ABOUT THE SERVICES, INCLUDING ANY REPRESENTATION THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND PROVIDE THE SERVICES (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, CINEARTERY AND ITS AFFILIATES DISCLAIM ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF TITLE, ACCURACY OF DATA, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CINEARTERY NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. USE OF ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE TELEPHONE, WIRELESS DEVICE OR DATA THAT RESULTS FROM THE USE OF THE SERVICES OR THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM CINEARTERY, ITS EMPLOYEES OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE AGREEMENT.
4.2 Limit of Liability
YOU AGREE THAT CINEARTERY SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF CINEARTERY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
CINEARTERY AND ITS AFFILIATES WILL NOT BE LIABLE TO YOU, IN RESPECT OF ANY SERVICE, WHETHER DIRECT OR INDIRECT, IN CONNECTION WITH THIS CONTRACT FOR ANY AMOUNT THAT EXCEEDS (A) THE TOTAL FEES PAID OR PAYABLE BY YOU TO CINEARTERY FOR THE SERVICES DURING THE TERM OF THIS CONTRACT, EXCEED FIFTY THOUSAND RUPEES (₹ 50,000) OR THE FEES PAID BY YOU DURING THE TWELVE (12) MONTHS PRIOR TO THE FIRST EVENT GIVING RISE TO SUCH LIABILITY, WHICHEVER IS HIGHER.
5 Suspension and Termination
We may suspend your user account or temporarily disable access to whole or part of any Service in the event of any suspected illegal activity, extended periods of inactivity or requests by law enforcement or other government agencies. Objections to suspension or disabling of user accounts should be made to cineartery@gmail.com within thirty days of being notified about the suspension. We may terminate a suspended or disabled user account after thirty days. We will also terminate your user account on your request.
In addition, we reserve the right to terminate your user account and deny the Services upon reasonable belief that you have violated the Agreement and to terminate your access to any Beta Service in case of unexpected technical issues or discontinuation of the Beta Service. You have the right to terminate your user account if Cine Artery breaches its obligations under this Agreement and in such event, you will be entitled to prorated refund of any prepaid fees. Termination of user account will include denial of access to all Services, deletion of information in your user account such as your email address and password and deletion of all data in your user account.
6 Product & Service Description
Cine Artery do not warrant that Product & Service description or other content of this Website is accurate, complete, reliable, current, or error-free and assumes no liability in this regard.
7 Modification of Terms of Service
We may modify this Agreement upon notice to you at any time through a service announcement or by sending email to your primary email address. If we make significant changes to the Agreement that affect your rights, you will be provided with at least 30 days advance notice of the changes by email to your primary email address. You may terminate your use of the Services by providing CineArtery notice by email within 30 days of being notified of the availability of the modified Agreement if the Agreement is modified in a manner that substantially affects your rights in connection with use of the Services. In the event of such termination, you will be entitled to prorated refund of the unused portion of any prepaid fees. Your continued use of the Service after the effective date of any change to the Agreement will be deemed to be your agreement to the modified Agreement.
8 Indemnification
You agree to indemnify and hold harmless Cine Artery, its officers, directors, employees, suppliers, and affiliates, from and against any losses, damages, fines and expenses (including attorney's fees and costs) arising out of or relating to any claims that you have used the Services in violation of another party's rights, in violation of any law, in violations of any provisions of the Agreement , or any other claim related to your use of the Services, except where such use is authorized by CineArtery.
9 Inactive User Accounts Policy
We reserve the right to terminate unpaid user accounts that are inactive for a continuous period of 120 days. In the event of such termination, all data associated with such user account will be deleted. We will provide you prior notice of such termination and option to back-up your data. The data deletion policy may be implemented with respect to any or all of the Services. Each Service will be considered an independent and separate service for the purpose of calculating the period of inactivity. In other words, activity in one of the Services is not sufficient to keep your user account in another Service active. In case of accounts with more than one user, if at least one of the users is active, the account will not be considered inactive.
10 Governing law and Jurisdiction
These Terms of Service and any separate agreements, any controversy or claim arising out of or relating to this Agreement, the formation of this Agreement or the breach of this Agreement, including any claim based upon an alleged tort, shall be governed by and construed in accordance with the laws of India. The courts in Bengaluru, Karnataka shall have the exclusive jurisdiction to hear any disputes that may arise under these Terms of Service.
